Legal regulation of shared-equity construction

Abstract

Практическая ценность работы заключается в актуальности темы исследования, поскольку механизм приобретения жилья путем заключения договора об участии в долевом строительстве является одним из самых популярных способов в настоящий момент. Поскольку право на жилище, предусмотренное Конституцией Российской Федерации, относится к одним из социальных и экономических прав человека, строительной отрасли присуща исключительная значимость в решении государственных задач, связанных с социальной политикой государства. Так, именно путем строительства объектов недвижимости создаются благоприятные условия для жизнедеятельности населения, в первую очередь, путем обеспечения граждан жильем. Объект исследования работы - отношения в сфере участия в долевом строительстве объектов недвижимости, регулируемые действующим законодательством Российской Федерации. Предмет исследования – договор участия в долевом строительстве, его существенные условия, а также законодательство, регулирующее отношения, возникающие на основании данного договора. Целью исследования является рассмотрение существенных условий договора участия в долевом строительстве и выявление проблем законодательного регулирования данного вида договоров. Методологическую основу исследования составили общенаучный, логический, исторический, системно-структурный и сравнительно-правовой методы. Данная исследовательская работа состоит из введения, двух глав, пяти разделов и заключения. Для написания работы использовалось 49 источников.

The practical value of the work lies in the relevance of the research topic, since the mechanism of acquiring housing by concluding an agreement on participation in shared-equity construction is one of the most popular methods at the moment. Since the right to housing provided for by the Constitution of the Russian Federation belongs to one of the social and economic human rights, the construction industry is of exceptional importance in solving state tasks related to the social policy of the state. Thus, it is through the construction of real estate objects that favorable conditions are created for the life of the population, primarily by providing citizens with housing. The object of the research is the relations in the field of participation in the shared construction of real estate objects regulated by the current legislation of the Russian Federation. The subject of the study is a contract of participation in shared–equity construction, its essential conditions, as well as legislation regulating relations arising on the basis of this contract. The purpose of the study is to consider the essential terms of the contract of participation in shared-equity construction and identify problems of legislative regulation of this type of contracts. The methodological basis of the study was made up of general scientific, logical, historical, system-structural and comparative legal methods. This research paper consists of an introduction, two chapters, five sections and a conclusion. 49 sources were used to write the work.
