Organizational and legal problems of providing preferential medicines to children in the Russian Federation

Abstract

Лекарственное обеспечение, ввиду социальной, общественной, государственной значимости, имеет сложное нормативное регулирование. Несовершенство законодательной базы, ведущее к недостаточному регулированию и финансированию отрасли, способствует появлению трудноразрешимых проблем. Граждане вынуждены отказываться от права на социальные льготы, ввиду невозможности их реализации, в пользу денежных выплат для покрытия расходов на лекарства, что ведет к нарушению солидарного принципа в системе социальной помощи. Решением проблемы может стать поиск новых источников финансирования и решение организационных задач при льготном обеспечении.

Drug provision, due to its social, public, and state significance, has a complex regulatory framework. The imperfection of the legal framework, leading to insufficient regulation and financing of the industry, contributes to the emergence of intractable problems. Citizens are forced to give up the right to social benefits, due to the impossibility of their implementation, in favor of cash payments to cover the cost of medicines, which leads to a violation of the solidarity principle in the social assistance system. The solution to the problem can be the search for new sources of funding and the solution of organizational tasks with preferential provision.
