Legal regulation in case of inadequate provision of plastic surgery services

Abstract

В настоящей работе исследуются правовые проблемы некачественного оказания услуг пластической хирургии. С этой целью автором проведен анализ российского законодательства о деятельности и профессиональной подготовке пластических хирургов, изучены вопросы гражданско-правового регулирования оказания услуг пластической хирургии, юридического оформления отношений между пациентом и медицинской организации, гражданской и уголовной ответственности пластических хирургов за ненадлежащее оказание услуг и критерии оценки качества таких услуг, проблемы квалификации и особенности расследования ятрогенных преступлений в пластической хирургии. Были выявлены пробелы в законодательстве, регулирующем деятельность пластических хирургов, типичные случаи некачественного оказания услуг в пластической хирургии и их причины, выработаны рекомендации по предотвращению таких случаев.

In this research are investigated the legal problems of poor quality of plastic surgery services. For this purpose, the author analyzes the Russian legislation on the activities and training of plastic surgeons, studies the issues of civil regulation of the provision of plastic surgery services, legal registration of relations between the patient and the medical organization, civil and criminal liability of plastic surgeons for improper provision of services and criteria for assessing the quality of such services, problems of qualification and features of investigation of iatrogenic crimes in plastic surgery. The study revealed the gaps in the legislation regulating the activities of plastic surgeons, typical cases of poor quality of services in plastic surgery and their causes, recommendations for the prevention of such cases were developed were identified.
