dc.description.abstractThis article provides results of a study of addressing inappropriate medical products, the responsibility for which is provided by Article 2381 of the Criminal Code of the Russian Federation. On the basis of a system analysis of the doctrine of criminal law, regulatory legislation for the circulation of medical products and law-enforcement practices in criminal cases lead to conclusions about the maintenance of concepts of production, sale, and import, and also the moment of terminating these socially dangerous acts. According to Article 2381, production of medicines is occurs at any stage in the relevant technological process creating a ready-made product in a large quantity. Production of medical products represents any stage in the technological process that allows reception of a ready-made product in a large quantity. Production of dietary supplements containing pharmaceutical substances that are not stated in registration with the state represents any actions for processing input products, creating a ready-made product in a large quantity. Sale, according to Article 2381, is understood traditionally, as paid or gratuitous transfer (expropriation) of a subject of crime to other persons. Import into the territory of the Russian Federation of counterfeited, unregistered, or substandard medical products represents movement of the specified products through the frontier of the Russian Federation or customs border of the Eurasian Economic Union from outside the territory of the Russian Federation. Controversial issues about qualification of criminal handling of medical products are also considered. The existing judicial practice of qualifying the sale of counterfeited, substandard, or unregistered medicines or medical products carried out during the operational investigation “Test purchase”, as a completed crime, has no legislative or law-enforcement grounds.en_GB
