Impact of non-tariff measures on the development of international trade

Abstract

В последние годы наметилась тенденции к активному применению нетарифных мер в международной торговле. Это было связанно с решением по либерализации торговли, принятом в ходе Уругвайского раунда. По различным оценкам международных организаций влияние данных мер на мировой импорт составляет от 18% до 30%. НТМ меры влияют на структуру и объем товарных поток между странами и их регулирование затрудняется, так как ВТО относит их к компетенции национального законодательства применяющей страны. В работе представлены доводы того, что эти меры могут быть инструментом протекционизма, когда речь идет об ограничениях и барьерах в международной торговле, и административными, когда говорим, о необходимости защиты жизни и здоровья людей и животных, безопасности окружающей среды и т.д. В работе исследовано влияние нетарифных мер (в частности санитарных и фитосанитарных мер) на международную торговлю, показан механизм регулирования этих мер по Соглашению СФС в рамках ВТО, проанализировано взаимодействие нормативно-правового регулирования санитарных и фитосанитарных мер в Евразийского экономическом союзе и Российской Федерации, рассмотрен опыт применения СФС мер Россией в отношении импортных товаров. Автором сделаны выводы о том, что влияние нетарифных меры на развитие международной торговли не однозначно. В некоторых случаев они приводит к сдерживанию международной торговли, в других случаях к ее стимулированию. Также было выявлено, что эти меры могут выступать, как инструмент политического давления на стран партнеров в торговле.

In recent years, there has been a trend towards active application of non-tariff measures in international trade. This was connected with the decision on trade liberalization adopted during the Uruguay Round. According to various estimates of international organizations, the impact of these measures on world imports ranges from 18% to 30%. NTM measures affect the structure and volume of commodity flows between countries and their regulation is hampered, since the WTO places them in the competence of the national legislation of the applying country. The paper argues that these measures can be an instrument of protectionism when it comes to restrictions and barriers in international trade and administrative, when talking about the need to protect the life and health of people and animals, environmental safety. The paper examines the impact of non-tariff measures (in particular sanitary and phytosanitary measures) on international trade, shows the mechanism for regulating these measures under the SPS Agreement within the WTO, analyzes the interaction of regulatory and legal regulation of sanitary and phytosanitary measures in the Eurasian Economic Union and the Russian Federation, the application of SPS measures by Russia in respect of imported goods. The author concludes that the influence of non-tariff measures on the development of international trade is not unambiguous. In some cases, they lead to the containment of international trade, in other cases to stimulate it. It was also revealed that these measures can act as an instrument of political pressure on partner countries in trade.
