Abstract
В работе поднимаются проблемы реализации субъектами малого и среднего предпринимательства преимущественного права на выкуп государственного имущества, связанные со спорами о стоимости имущества, способами защиты нарушенных прав. Анализируется механизм действия преимущественного права, а также судебный перевод прав и обязанностей как способ защиты преимущественного права. Выполнен мониторинг судебной практики, указывающий как на способы злоупотреблений со стороны арендодателей, так и на способы противодействия этим злоупотреблениям.
The paper raises the problem of the implementation by small and medium-sized businesses of the preemptive right to buy out state property related to disputes over the value of property, ways of protecting violated rights. The mechanism of action of the preemptive right is analyzed, as well as the judicial transfer of rights and obligations as a way to protect the preemptive right. The monitoring of judicial practice was carried out, indicating both ways of abuse by landlords and ways of countering these abuses.
