The object of crime under Article 123 of the Criminal code of the Russian Federation

Abstract

The author analyzes the object of crime under Art. 123 of the Criminal сode. Currently, criminal law provides criminal penalties for an illegal abortion only if it was performed by individual who has no medical education and skills. According to the author’s position, this situation is a result of understanding the crime’s object as addressing social relations in the sphere of protection of the life and health of the pregnant woman. Many cases have revealed doctors’ mistakes and their iatrogenic effects. It means that we need change our opinion about the object of the crime under Art. 123 of the Criminal сode and include these social relations as an additional object. Refs 8.
