Use of cohesive devices in French and Russian court decisions as a translation issue

Abstract

Одной из основных особенностей судебного дискурса является жёсткая логическая организация изложения, благодаря которой обеспечивается ясность, смысловая законченность и однозначность судебного решения. Такая степень организации достигается за счёт применения при изложении материала средств языковой когезии, обеспечивающих связь между структурными элементами текста. Данная работа посвящена изучению коннекторов, используемых французскими и российскими судьями для достижения языкового единства и логической связности судебных решений. В процессе исследования выявлены и систематизированы преобладающие в судебных решениях Франции и России типы отношений, а также коннекторы, используемые для их выражения. Представленные по результатам исследования таблицы, отражающие употребление коннекторов в судебных решениях российских и французских инстанций, могу быть использованы в качестве основы для перевода судебных решений.

One of the main characteristics of judicial discourse is the rigid logical organization of the presentation, which ensures clarity, semantic completeness, and unambiguity of the court decision. This degree of organization is achieved through the use of linguistic cohesion devices, which provide a connection between the structural elements of the text. This research is devoted to the study of connectors used by French and Russian judges to achieve linguistic unity and logical coherence of court decisions. During the research, the types of relations prevailing in the judicial decisions of France and Russia, as well as the connectors used for their expression, are identified and systematized. The tables presented according to the results of the study, reflecting the use of connectors in court decisions of Russian and French instances, can be used as a basis for translation of court decisions.
