The international refugee protection system: a study of the Western Saharan refugees Sahrawi

Abstract

Работа посвящена исследованию имплементации механизмов международной защиты беженцев для обеспечения защиты западносахарских беженцев сахрави. Целью работы выступает выявление проблем международной защиты западносахарских беженцев. Актуальность исследования обусловлена масштабом вынужденных перемещений во всем мире и необходимостью улучшения положения беженцев сахрави, которые более сорока лет изолированно живут в пустыне Алжира, пребывая в зависимости от международной гуманитарной помощи. Автор работы дает общую характеристику международному праву беженцев, изучает положение западносахарских беженцев сахрави в Алжире, выявляет особенности политики принимающего государства в отношении западносахарских беженцев, исследует работу международных организаций в лагерях беженцев сахрави и выносит рекомендации по усовершенствованию механизмов международной защиты западносахарских беженцев. В работе выделено два уровня международной защиты беженцев – развитие механизмов международного сотрудничества и реализация государственной политики в области защиты беженцев в соответствии с выработанными многосторонними механизмами и подходами. Установлено, что в лагерях беженцев сахрави наиболее эффективными выступают механизмы международного сотрудничества, связанные с работой международных организаций. Ключевыми препятствиями в работе международных организаций в лагерях сахрави являются недостаток финансирования и контроль их деятельности со стороны руководства лагерей беженцев сахрави – военно-политического движения за независимость Западной Сахары Фронта ПОЛИСАРИО. Выявлено, что механизмы международной защиты беженцев второго уровня, связанные с развитием национальных инструментов, не демонстрируют должной эффективности в вопросах обеспечения защиты беженцев сахрави, поскольку государство Алжир делегировало свои суверенные полномочия Фронту ПОЛИСАРИО на территории лагерей беженцев и практически не участвует в реализации мер защиты и поддержки западносахарских беженцев. В результате исследования определены проблемы международной защиты сообщества беженцев сахрави, предложены пути усовершенствования направлений их защиты, сделаны прогнозы относительно развития системы защиты беженцев сахрави в будущем и представлены обобщения о некоторых недостатках защиты беженцев в мире.

The thesis is devoted to the study of the implementation of international refugee protection mechanisms, which provide protection for the Western Saharan refugees Sahrawi. The research is aimed to determine problems of international refugee protection of the Western Saharan refugees. The relevance of the research stems from the scale of forced displacement around the globe and the need to improve the situation of the Sahrawi refugees, who have been living in isolation in the Algerian desert for more than 40 years, being dependent on international humanitarian aid. The author characterizes international refugee law, examines the situation of the Western Saharan refugees Sahrawi, determines the features of the host state’s policy towards the Western Saharan refugees, explores the work of international organizations in the Sahrawi refugee camps, and makes recommendations for improving the mechanisms of international protection of the Western Saharan refugees. The thesis identifies two levels of international refugee protection, which are the development of international cooperation and the implementation of a state policy in the field of refugee protection according to multilateral mechanisms and approaches. The research found that in the Sahrawi refugee camps the mechanisms of international cooperation linked with the activity of international organizations are the most effective. The key obstacles to their work in the Sahrawi camps are the funding shortfall and control of their activity by the military-political movement for the independence of Western Sahara named the Polisario Front, which is the leadership of the Sahrawi refugee camps. The paper defined that the second-level mechanisms of international refugee protection do not show the necessary effectiveness in providing protection for the Sahrawi refugees, since Algeria delegated its sovereign functions to the Polisario Front in the territory of the refugee camps and almost does not participate in the implementation of measures to protect and support the Western Saharan refugees. As a result of the study, the problems of international protection of the Sahrawi refugee community are identified, the ways of improving their protection are proposed, the scenario is elaborated regarding the development of the Sahrawi refugee protection system in the future, and the generalizations are made about several weaknesses of international refugee protection in the world.
