Some issues related to overturning the execution of a judgement

Abstract

Цели исследования: анализ законодательства и судебной практики с точки зрения выстраивания нормативной модели распределения имущественных рисков при повороте исполнения судебного решения о взыскании денежных средств (определение момента начисления процентов по статье 395 ГК РФ). Задачи исследования: 1) характеристика правовой природы поворота исполнения в контексте применения статьи 395 ГК РФ; 2) анализ действующего регулирования механизма поворота исполнения и оценка оснований осуществления поворота исполнения при отсутствии итогового судебного акта, разрешившего спор по существу; 3) разбор подходов, выработанных судебной практикой, к определению момента начисления процентов при повороте исполнения; 4) обоснование момента начисления процентов в случае отказа в иске при повторном рассмотрении дела; 5) поиск причин, обуславливающих начисление процентов по статье 395 ГК РФ при завершении повторного рассмотрения дела без вынесения решения по существу; 6) выявление значения заблуждения стороны относительно наличия права или отсутствия обязанности, порожденного временной законной силой судебного решения, в целях построения модели справедливого распределения имущественных рисков, выражающихся в начислении процентов при повороте исполнения судебного решения о взыскании денежных средств. На защиту выносятся следующие положения: 1) распределение имущественных рисков, вызванных судебной ошибкой, должно быть основано на презумпции добросовестного заблуждения победившей стороны о наличии права или отсутствии обязанности, которая освобождает от начисления процентов до момента отмены ошибочного судебного решения; 2) решение об отказе в иске при повторном рассмотрении дела влечет начисление процентов при повороте исполнения с момента отмены судебного решения. С этого времени истец самовольно пользовался денежными средствами, что недопустимо при нахождении сторон в состоянии спора о праве, в котором ни один из равных субъектов не может односторонним волеизъявлением обогатиться за счет оппонента. 3) при завершении процесса без разрешения спора по существу момент начисления процентов должен зависеть от того, находятся ли основания окончания производства в сфере контроля истца. Если находятся (оставление без рассмотрения, отказ от иска), то проценты должны начисляться с момента отмены судебного решения, если не находятся – с момента вступления в силу итогового судебного акта. 4) необходимость принятия нового решения по делу для осуществления поворота исполнения вызвана тем, что отмена судебного решения сама по себе не свидетельствует о неправомерности притязаний истца, позиции сторон равноудалены от суда и до разрешения спора по существу отсутствуют основания для принудительного перераспределения имущественных благ; 5) окончание производства по делу без вынесения решения по существу не препятствует повороту исполнения. При оставлении иска без рассмотрения поворот осуществляется в отношении истца, чье процессуальное поведение препятствовало разрешению спора. Прекращая производство по делу в связи с неподведомственностью, суд восстанавливает первоначальное имущественное положение, нарушенное вмешательством неполномочного суда. При отказе истца от иска поворот исполнения обусловлен обеспечением баланса интересов истца, утратившего заинтересованность в поддержании процесса, и ответчика, желающего вернуть денежные средства, перечисленные по отмененному судебному акту.

Purposes of the research: analysis of legislation and judicial practice from the point of view of building a regulatory model for the distribution of property risks in the overturning the execution of judgment to the recovery of funds (determination of the moment of accrual of interest under Article 395 of the Civil Code of the Russian Federation). Objectives of the research: 1) characteristic of the legal nature of the overturning the execution of judgment in the context of the application of Article 395 of the Civil Code of the Russian Federation; 2) analysis of the current regulation of the mechanism of the overturning the execution of judgment and evaluation of the grounds for the overturning the execution of judgment in the absence of a resolution of case in essence; 3) analysis of approaches developed by judicial practice to determining the moment when interest is charged on the overturning the execution of judgment; 4) substantiation of the moment of the accrual of interest in case of the judgement of dismissal in the second trial; 5) search for the reasons causing the accrual of interest under Article 395 of the Civil Code of the Russian Federation at the completion of second trial without a resolution of case in essence; 6) revealing the value of the party's wrong belief regarding the existence of the right or lack of the obligation generated by the temporal legal force of the judgment in order to construct a model for the fair distribution of property risks expressed in the calculation of interest when the overturning the execution of judgment on the recovery of funds. The following theses are made for defense: 1) the distribution of property risks caused by a judgment mistake must be based on a presumption of bona fide wrong belief of the winning party about the existence of right or absence of the duties, which exempts from the calculation of interest until the reversal of the erroneous judgment; 2) the judgement of dismissal in the second trial entails the accrual of interest in the overturning the execution of judgment from the moment of the reversal of the judgment. Since then, the plaintiff used the funds voluntary, which is unacceptable when the parties are in a state of dispute about the right, in which no one of the equal subjects can enrich himself at the expense of the opponent by unilateral will. 3) at the completion of second trial without a resolution of case in essence the moment of accrual of interest should depend on whether the grounds for completing the proceedings are in the control of the plaintiff. If they are (leaving without investigation, refusal of the claim), then the interest should be accrued from the moment of reversal of the judgment, if they are not the interest should be accrued from the moment of entering into force of the final judgment. 4) the necessity to adopt a new judgment to the overturning the execution of judgment is due to the fact that the reversal of the judgment does not itself testify to the illegality of the plaintiff’s claims, the parties' positions are equidistant from the court and until the dispute is resolved there is no grounds for compulsory redistribution of property goods; 5) at the completion of second trial without a resolution of case in essence does not prevent the overturning the execution of judgment. If the claim is left without investigation, the overturning the execution of judgment is made against the plaintiff, whose procedural behavior hinders the resolution of the case. Cessation of proceedings with lack of jurisdiction, the court restores the original property position, violated by the intervention of the illegal court. If the plaintiff refuses from the claim, the overturning the execution of judgment is due to the balance of interests of the plaintiff who has lost interest in supporting the process and the defendant who wants to return the funds listed on the canceled judgment.
