Bankruptcy of physical persons: the procedure of debt restructuring

Abstract

В выпускной квалификационной работе исследуются нормы, регулирующие новую процедуру банкротства - процедуру реструктуризации долгов гражданина. Внимание уделяется особенностям правового регулирования процедуры реструктуризации долгов гражданина, а также причинам ее низкой эффективности в России. Детально анализируются основные ограничения сделкоспособности гражданина-должника (необходимость согласования с финансовым управляющим совершения отдельных сделок или запрет на их совершение), в деле о банкротстве которого применяется реабилитационная процедура реструктуризации долгов; особое внимание уделяется последствиям нарушения данных ограничений.

The paper touches upon the rules on restructuring personal debts, which is a new bankruptcy procedure.It attends to legal matters arising at period of restructuring during insolvency procedure of natural persons and causes of its inefficiency in Russia.The article analyzes in detail the basic restrictions of the obility of citizen-debtor to make deals (the necessity of coordination with the financial control commission of certain transactions or a ban on their commission), in the case of bankruptcy is applied rehabilitation procedure debt restructuring; special attention is paid to the consequences of a breach of these restrictions.
