dc.description.abstract | Объектом исследования выступают регулируемые нормами уголовного права общественные отношения, складывающиеся в процессе неоказания или ненадлежащего оказания медицинской помощи. Предмет исследования составили: нормы законодательства, регламентирующие расследования причинения вреда здоровью в результате медицинской деятельности. Целью диссертационного исследования является комплексное изучение уголовно-правовых проблем ненадлежащего оказания и неоказания медицинской помощи, а равно обоснование и разработка совокупности теоретических положений, которые направлены на совершенствование норм уголовного законодательства, обеспечивающих охрану здоровья и жизни пациента при медицинском вмешательстве. Итоги проведенной работы содержатся в следующих основных положениях и выводах: В группу врачебных преступлений предлагается относить следующие преступления: 1) причинение смерти по неосторожности вследствие ненадлежащего исполнения лицом своих профессиональных обязанностей (ч. 2 ст. 109 УК РФ); 2) причинение тяжкого вреда здоровью по неосторожности вследствие ненадлежащего исполнения лицом своих профессиональных обязанностей (ч. 2 ст. 118 УК РФ); 3) заражение лица ВИЧ-инфекцией вследствие ненадлежащего исполнения лицом своих профессиональных обязанностей (ч. 4 ст. 122 УК РФ); 4) незаконное производство аборта (ст. 123 УК РФ); 5) неоказание помощи больному (ст. 124 УК РФ). Основные направления эволюции нормативного регулирования ответственности медицинского персонала за причинение смерти или вреда здоровью пациентов при осуществлении профессиональных функций состояли в: повышении оценки общественной опасности (от проступков к преступлениям); дифференциации ответственности в зависимости от вида причиняемого вреда и вида медицинской деятельности, при осуществлении которой этот вред причинен; уточнении субъективных критериев разграничения невиновного и виновного причинения вреда медицинским работником. | ru_RU |
dc.description.abstract | The object of the research is the social relations regulated by the norms of criminal law, which are formed in the process of refusal or inadequate medical care. The subject of the study was: the norms of legislation governing the investigation of damage to health as a result of medical activities. The purpose of the dissertation research is a comprehensive study of the criminal legal problems of improper provision and non-provision of medical care, as well as the rationale and development of a set of theoretical provisions that are aimed at improving the norms of criminal legislation that protect the health and life of the patient during medical intervention. The results of the work carried out are contained in the following main provisions and conclusions: The following crimes are proposed to the group of medical crimes: 1) causing death by negligence as a result of improper performance by a person of their professional duties (Part 2, Article 109 of the Criminal Code of the Russian Federation); 2) causing serious harm to health through negligence due to improper performance by a person of their professional duties (Part 2, Article 118 of the Criminal Code); 3) infection of a person with HIV infection due to improper performance by a person of their professional duties (Part 4, Article 122 of the Criminal Code); 4) illegal manufacture of an abortion (item 123 of the criminal code of the Russian Federation); 5) failure to provide assistance to the patient (Article 124 of the Criminal Code). The main directions of the evolution of the regulatory regulation of the responsibility of medical personnel for causing death or damage to the health of patients in the performance of professional functions were: to increase the assessment of the public danger (from misdemeanors to crimes); differentiation of responsibility, depending on the type of harm caused and the type of medical activity in the implementation of which this harm is caused; clarifying the subjective criteria for distinguishing between the innocent and the guilty causing of harm by a medical worker. | en_GB |
