Ways and means of constitutionalisation of social relations (a case study of the practices of the Constitutional Court of the Russian Federation)

Abstract

В настоящей работе изучается феномен конституционализации общественных отношений, исследуются различные подходы к данному понятию в отечественной и зарубежной доктрине. Автором выделены политический и судебный способ конституционализации общественных отношений, охарактеризованы прямые и обратные связи между конституционными и отраслевыми принципами, правами и ценностями. Основная часть работы посвящена выделению приемов конституционализации общественных отношений, вырабатываемых Конституционным Судом РФ самостоятельно в процессе своей деятельности. В ходе исследования сделаны в том числе следующие выводы: 1. Конституционализация в российской правовой доктрин рассматривается как процесс насыщения общественных отношений, правовых институтов конституционно-правовыми нормативными ценностями. В зарубежной доктрине учитывается глубокая степень интеграции с международным пространством. 2. Выделены такие приемы конституционализации общественных отношений, выработанные Конституционным Судом РФ в процессе своей деятельности самостоятельно, как использование принципа пропорциональности, отыскание баланса частных и публичных отношений, а также апеллирование к конституционному принципу равенства.

The phenomenon of the constitutionalization of social relations is studied in the present work, various approaches to this concept in the domestic and foreign doctrine are explored. The author singled out the political and judicial way of the constitutionalization of social relations, the direct and inverse relations between constitutional and branch principles, rights and values are characterized. The main part of the work is devoted to highlighting the methods of constitutionalization of public relations, developed by the Constitutional Court of the Russian Federation independently in the process of its activities. The author made the following conclusions, including: 1. Constitutionalization of social relations in the Russian legal doctrine is developing as a process of saturation of social relations, legal institutions with constitutional and legal normative values. The foreign doctrine takes into account the high degree of integration with international space. 2. The author singles out methods of the constitutionalization of social relations such as elaborated by the Constitutional Court of the Russian Federation in the course of their activities independently, using of the principle of proportionality, finding the balance of private and public relations and appealing to the constitutional principle of equality.
