Abstract

Работа состоит из введения, двух глав, заключения и списка использованной литературы. Целью настоящей работы является анализ отношений связанных с заключением и исполнением энергосервисного договора в рамках энергосберегающих действий. Во введении раскрывается актуальность выбранной темы, описываются цели и задачи выпускной квалификационной работы В первой главе изложено понятие энергосервисного договора, раскрывается его место в системе российского права, его элементы, предмет, цена, срок, стороны, форма и содержание. Данные понятия раскрываются, подвергаются анализу, в них выделяется проблема, и выносятся возможные пути решения оных Во второй главе, посвященной регулированию договорных связей связанных с энергосервисом в США и странах Европы, проводится раскрытие правого регулирования и практики заключения договорных связей в данной области через призму изучения наднационального европейского законодательства, а также через изучение непосредственно договоров в таких странах как США, Германия, Франция и Великобритания. В заключении подводится итог самой работе, обобщаются положения и позиции, высказанные в самой работе, возможные пути решения проблем, такие как: замена термина в настоящем законодательстве на «энергетические ресурсы», определить в законодательстве какой именно срок должен быть указан в договоре, необходимость более детального рассмотрения качества оказания энергосервисной услуги и возможность использования в России французского Chauffage контракта, под конец приводится заключительное слово.
