The European Union's attitude to the amendment to the law on the Constitutional Court in Poland

Abstract

В работе исследуется деятельность основных институтов Европейского Союза в области кризисного регулирования на примере ситуации вокруг Конституционного Трибунала в Республике Польша в 2016 г. В ходе исследования были определены законодательные возможности ЕС участвовать во внутренних процессах в государствах-членах, а также описан механизм действия ЕС в случае установления существенных нарушений его основных принципов одним из государств-членов. Проведен анализ практической деятельность Европейской Комиссии, Европейского Парламента, Европейского совета и Совета Европейского Союза в данном направлении. В ходе исследования удалось раскрыть определенные недостатки в существующем наборе инструментов ЕС для урегулирования внутренних кризисов на европейском пространстве.

The paper examines the activities of the main institutions of the European Union in the area of crisis management using the case of the 2016 Constitutional Tribunal in the Republic of Poland. The study identified the legislative possibilities of the EU to participate in the internal processes in the Member States as well as described the mechanism of EU action in case of serious violations of its basic principles by one of the Member States are determined. An analysis of practical activity of the European Commission, the European Parliament, the European Council and the Council of the European Union in this direction has been analyzed. The study succeeded in revealing certain shortcomings in the existing set of EU instruments for resolving internal crises within the European area.
