REVIEW for graduate qualification work of the master's program "Medical and Pharmaceutical Law", prepared by the student of group 21.M18-yu Stolyarenko Artem Gennadievich, on the topic Monitoring and prevention of adverse medical outcomes: legal aspects The author refers to actual topic of patient safety, detection and prevention of adverse medical outcomes. The first chapter of the paper analyzes the concept of adverse outcome, its relation to the medical error; the author concludes that the causes of adverse outcomes can be various objective and subjective factors. A common feature of all adverse outcomes is that they are an unintended and often unforeseen consequence of medical intervention. Medicine and law should therefore offer mechanisms for monitoring and preventing such outcomes - as part of a patient safety framework. In chapters two, three and four of this paper, the author turns to the tools that exist in international practice to prevent or reduce the number of medical errors: civil law (tort) liability for causing harm to a patient; professional liability insurance of medical care providers; and the control powers of medical insurance organizations within the system of compulsory medical insurance (CMI). The author identifies certain features of the Russian health care system and Russian legal system that do not encourage medical professionals to improve the quality of their work and find out the causes of complications of medical intervention (the predominance of budget medical institutions, the lack of personal property responsibility of medical professionals to the patient). The perspectives of introducing in Russia compulsory and imputed insurance of responsibility for causing harm to a patient are analysed, a draft of a Model law for the CIS countries is studied. The independent analysis of the raised questions and scientific novelty, use of the Russian and foreign literature sources and the relevant statutory acts are the key characteristics of this work. On the whole, the work by A.G. Stolyarenko meets the requirements for the graduate qualification master's thesis, and can be admitted for defence.
